In his order on a batch of 15 writ petitions by parents and CBSE school students and school managements, Justice K Chandru said the interim oder will remain in force till the government spelt out a policy keeping in mind students' interests.
The petitioners sought to quash a July 23, 2008, order by the Director of School Education asking school education department not to permit students of schools affiliated to the CBSE to participate in sports tournaments conducted by it from academic year 2008-09. The Judge directed the state government to have a broad based consultation with all stake holders and if necessary to form a panel to consider the issue raised in the petitions.
He told the authorities to arrive at a proper solution, "which will be crystallised in the form of a policy of the government in consonance with the constitutional mandate considering the interests of future school going children". He said it was entirely for the state government to frame guidelines for forming an appropriate committee.
The CBSE students sought to consider them on par with their state board counterparts while applying to various courses under sports quota.
