Court restores curbs on Airtel 3G roaming
New Delhi, April 4 (IANS) The Delhi High Court Thursday set aside its earlier order which allowed telecom operator Bharti Airtel to continue providing 3G intra-circle roaming facilities with other service providers.
A division bench of Chief Justice D. Murugesan and Justice V.K. Jain set aside the order that lifted curbs imposed by a single judge March 18 on the Department of Telecommunications' (DoT) March 15 notification restraining Airtel from providing 3G intra-circle roaming facilities.
The DOT asked the Airtel to stop intra-circle 3G roaming in seven circles where it did not have the telecom spectrum and also imposed a penalty of Rs.350 crore for violating the licence terms and conditions.
The division bench's order came on a plea filed by Reliance Communications challenging the March 18 court order, saying it had been "incurring huge losses for the 3G on daily basis and Bharti Airtel has been using it free of cost".
